General terms and conditions of sale
The present conditions of sale are concluded on the one hand by the company KONSIGN with a capital of 10,000 euros, whose registered office is at 38120 FONTANIL-CORNILLON, 13 rue Rif Tronchard, registered in the GRENOBLE Trade and Companies Register under number 789 431 541 00018, hereinafter referred to as "SKICASE", and on the other hand by any individual or legal entity wishing to make a purchase via the website www.myskicase.com, the Skicase mobile application or a Skicase kiosk, hereinafter referred to as "the buyer".
Object
The purpose of these terms and conditions of sale is to define the contractual relationship between SKICASE and the purchaser, and the conditions applicable to all purchases made via the MySkicase.com merchant site, the SKICASE mobile application and one of SKICASE's physical terminals, whether the purchaser is a professional or a private individual. Sales made directly at the cash desk are not covered by these GCS.
The acquisition of a good or service through one of these channels implies unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale will prevail over any other general or special conditions not expressly approved by SKICASE.
SKICASE reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the buyer's order.
Characteristics of goods & services
The products and services offered are those listed in the catalog published on the SKICASE website.
These products and services are offered within the limits of available stocks.
Rates
The prices shown on the website, the mobile application and the terminal are prices including VAT in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.
SKICASE reserves the right to modify its prices at any time, it being understood, however, that the price shown on the website on the day of the order will be the only one applicable to the buyer.
Geographical area
The online sale of products and services presented on the website and mobile application is available worldwide. The realization of the service is done at the address indicated at the time of the purchase on the website or the mobile application, or directly at the place of purchase when booking from a physical terminal.
Controls
The buyer, who wishes to buy a product or a service must obligatorily :
- Fill in his name or nickname, cell phone number and email address;
- validate his order after having checked it;
- make the payment in accordance with the conditions;
- confirm his order and payment.
The confirmation of the order implies acceptance of these terms of sale, the recognition of having perfect knowledge and waiver of its own conditions of purchase or other conditions.
All the data provided and the recorded confirmation will be worth proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.
The seller will communicate by e-mail and SMS the confirmation of the registered order.
Reservation cancellation & modification
The buyer, a non-professional individual, benefits from a withdrawal period of up to 7 days before the rental start date of the locker. This can be requested at info@myskicase.com or directly from the link in the confirmation e-mail.
Less than 7 days before the start of the reservation, requests will be studied on a case-by-case basis by SKICASE. No refunds will be made after the start of the rental of the locker, except in the event of an event beyond the control of the purchaser (closure of the locker, failure of the locker, closure of the resort or store, etc.). Where specific conditions apply, the withdrawal and cancellation conditions may be modified (see Specific Conditions section).

All claims should be sent to info@myskicase.com.
Terms of payment
The price is due at the time of order.
Payments will be made by credit card; they will be made through the secure payment platform STRIPE so that the information transmitted is encrypted by a software and that no third party can take cognizance of it during the transport on the network.
The buyer's account will be debited at the time of the order.
Responsibility
The seller, in the process of selling online, is only bound by an obligation of means; its responsibility cannot be engaged for any damage resulting from the use of the Internet network such as data loss, intrusion, virus, service failure, or other unintended problems.
Specific conditions
Specific terms and conditions of sale may apply depending on the location where the reservation was made. In this case, the buyer will have access to them at the time of the order and will have to accept them.

Intellectual Property
All elements of the SKICASE site are and remain the exclusive intellectual property of SKICASE
. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or sound.
Any simple link or hypertext link is strictly forbidden without the express written consent of SKICASE.
Personal data
In accordance with the French Data Protection Act of January 6, 1978, nominative information relating to purchasers may be processed automatically.
SKICASE reserves the right to collect information on purchasers, including by using cookies, and, if it so wishes, to pass on the information collected to commercial partners.
Purchasers may object to the disclosure of their details by notifying SKICASE. Similarly, users have a right to access and rectify data concerning them, in accordance with the law of January 6, 1978.
The automated processing of information, including the management of e-mail addresses of users of the site was the subject of a declaration to the CNIL on 22/8/2014 registered under number 1788515.
We collect only the data necessary for the proper functioning of the SKICASE service, namely the processing of orders. These are kept for a period of 10 years.
All security measures are implemented to protect the personal data of our customers (protection against unauthorized access attempts, backup, encryption of connections (SSL)).

Archiving - Proof
SKICASE shall file the order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the Civil Code.
The computerized records of SKICASE shall be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Dispute Resolution
The present conditions of sale on line are subjected to the French law.
In the event of litigation, jurisdiction is attributed to the competent courts of Paris, notwithstanding multiple defendants or appeal in guarantee.
